By using Pointii, you are agreeing to these terms. Please read them carefully.
Pointii is a gamified, online program designed to help educators prepare students for work.
With Pointii, Students learn about who they are, their skills, and career interests through interactive media and incentive-based modules. As Students prepare for work through competition with peers and cool challenges, they create elevator pitches, career plans, student-focused plans, reference lists, and more, while they earn points for their achievements.
Pointii also provides Educators with access to tools that enable them to monitor the progress of their students, initiate relevant conversations, and to communicate with students to help them prepare for work and life.
To use Pointii, you must follow the Terms of Use.
You agree not to use Pointii for any purpose that is unlawful or prohibited by these terms. For example, you may not use Pointii in any manner that could damage, disable, overburden, or impair Pointii or interfere with any other party’s use and enjoyment of Pointii. You may not obtain or attempt to obtain any Pointii Content or information through any means not intentionally made available or provided for or through Pointii.
You agree not to submit or transmit any content, files, videos, photos, web links, or other materials to Pointii that: (i) are defamatory, threatening, obscene, or harassing, (ii) contain a virus, worm, or any other harmful component, or (iii) otherwise violate any applicable laws.
We may suspend or stop providing Pointii to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Pointii, including all Pointii Content and any software used by Pointii, Inc. to provide Pointii, is protected by copyright under United States, foreign laws and international treaties. Unauthorized use of Pointii may violate copyright, trademark, and other laws.
Using Pointii does not give you ownership of any intellectual property rights in Pointii or the Pointii Content you access.
You may not store, modify, reproduce, transmit, reverse engineer, create derivative works, or distribute a portion of the Content of Pointii.
You may not copy the design, layout, organization, or “look and feel” of Pointii in any form or media. The systematic retrieval of data from Pointii is also prohibited.
You may access, download, and print materials from Pointii solely for your personal and non-commercial use. No right, title, or interest in any of the Content contained in Pointii is transferred to you as a result of accessing, downloading, or printing such Content.
If you submit feedback, suggestions, or ideas about how to improve Pointii, we may use your feedback, suggestions, or ideas without obligation to you.
Your Pointii Account will be assigned to you by an Administrator or Educator from your educational institution.
To protect your Pointii Account, keep your password confidential. You are responsible for the activity that happens on or through your Pointii Account.
You shall notify Pointii of any known or suspected unauthorized use of your Account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password. You shall be responsible for maintaining the confidentiality of your password.
If you are a Student, please be aware that content you upload, submit, store, or send to Pointii will be viewable by Educators at your educational institution.
While using Pointii you can upload, submit, store, send, or receive content. You retain ownership of any intellectual property rights that you hold in that content.
When you upload, submit, store, send, or receive content to or through Pointii, you give Pointii a worldwide, perpetual, royalty-free, non-exclusive license to use, host, store, reproduce, display, publish, modify, and delete the content, subject to the restrictions of our Privacy Policy.
At all times, you are responsible for the content you post to Pointii.
Pointii’s privacy policy explains how we treat your personal data and protect your privacy when you use Pointii. By using Pointii, you agree that Pointii, Inc. can use such data in accordance with our privacy policies.
We provide Pointii using a commercially reasonable level of skill and care. We hope you will enjoy using our product and services.
But other than as expressly set out in these terms we do not make any specific promises about Pointii. For example, we don’t make any commitments about the accuracy, completeness, currency, or reliability of the Content within Pointii, the specific functions of Pointii, or Pointii’s reliability, availability, or ability to meet your needs. We provide Pointii “as is.”
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we exclude all warranties.
When permitted by law, Pointii, Inc. will not be responsible for lost profits, revenues, or data, financial losses, or indirect, special, consequential, exemplary, or punitive damages.
To the extent permitted by law, the total liability of Pointii,Inc. for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use Pointii.
You agree to defend and indemnify Pointii, Inc., its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities, and settlements including without limitation, reasonable legal and account fees, resulting from or alleged to result from your violation of these Terms of Use.
Pointii, Inc. may, at any time, make changes to Pointii, including its “look and feel,” features, and Content.
We may also modify these terms or any additional terms that apply to Pointii, for example, to reflect changes to the law or changes to Pointii. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll also post notice of modified terms in Pointii. Changes will not apply retroactively and will become effective no sooner than 14 days after they are posted. However, changes addressing new functions for Pointii or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for Pointii, you should discontinue your use of Pointii.
If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
These Terms of Use shall be governed by the laws of the United States of America. If an applicable law is in conflict with any part of the Terms of Use, the Terms of Use will be deemed modified to conform to the law. The other terms will not be affected by any such modification.
If it turns out that a particular term is not enforceable, this will not affect any other terms.
If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
You may have other agreements with Pointii, Inc. Those agreements are separate and in addition to these Terms of Use. These Terms of Use do not modify, revise, or amend the terms of any other agreements you may have with Pointii, Inc.
